Pre-Amble
We, the Student council of Brier Elementary School, in order to form a more perfect school, establish an efficient and productive student governement, do create and establish this Constitution.
Limits of Authority
Since the principal is directly responsible for the welfare of the school, it is expressly understood that powers herein delegated to the Student Council are in whole subject to the advise and consent of the principal or his designee.
Article I: Establishment
We, the staff and students of Brier Elementary School, have established an organization entitled, The Brier Elementary School Student Council.
Article II: Purpose
The primary purpose of this organization will be to:
A. Encourage and maintain good citizenship and a cooperative spirit within the student body.
B. Practice positive leadership and cooperation skills.
C. Serve as liaisons between the Student council and the homerooms.
D. Serve as liaisons between students and school personnel.
E. Plan and perform service projects to benefit the school and community.
Article III: Membership
The member of the Brier Elementary School Student Council shall consist of:
A. One student representing each classroom 4th-6th with each having a non-voting alternate.
B. Officers (President, Vice-President, and Secretary)
C. The Student council will elect a President, Vice President, and Secretary before the second week in June.
D. Officers will meet in the fall with advisor(s) to go over duties.
E. By the end of the third week of school, the Student Council will be introduced.
Article IV: Representatives, election of
Section 1: (Qualifications) A student who wishes to be a candidate for the Student Council shall:
1. Be a good citizen.
2. Be a hard-working and diligent student.
3. Relate well to other students and adults.
4. Be interested in being a council representative.
Section 2: (Nominations) Each homeroom in Grades 4, 5, 6th shall nominate two or more students to be candidates for election.
Section 3: (Elections) Election of Student Council representatives shall take place in 4-6th grade classrooms by the 25th of September of each school year. The student receiving the majority (plurality) of votes shall be declared the representative. The student receiving the 2nd highest number of votes shall serve as alternate.
Section 4: (Powers and Duties) Each representative shall be responsible for performing the duties of the representative as listed in the Constitution.
Section 5: (Term of Office) The term of office shall be for one (1) school year.
Article V: Representatives, duties of
The responsibility of the representative members are:
Article VI: Officers, election of
The election process shall be as follows:
A. Students interested in becoming officers shall submit applications before the 3rd week of May.
B. The Student Council will elect a President, Vice President, and Secretary before the second week in June.
C. Officers will meet in the fall will advisor(s) to go over duties.
D. By the end of the third week of school, the Student Council concept will be introduced.
E. By the end of the 3rd week of the school, student contracts need to be signed by the student and handed into homeroom teachers, as required by the nomination process.
Article VII: Officers, duties of
A. The responsibilities of the following officers are:
1. President: (The Leader)
i. Leads and directs the Council in all its activities.
ii. Represents the Student Council and the school.
iii. Delegate responsibilities using everyone’s talents.
iv. Attend all the meetings.
v. Positive role model.
2. Vice President (The Mover)
i. Leads meetings if the president is absent.
ii. Helps the President
iii. Coordinates activities with committee chair people.
iv. Reads the Treasury report.
v. Attend all the meetings.
vi. Positive role model.
3. Recording Secretary (The Recorder)
i. Writes and reads the minutes of the meetings.
ii. Reports and records.
iii. Assumes responsibility.
iv. Attend all the meetings.
v. Positive role model.
Article VIII: Meetings
Section 1:
Student Council meetings shall take place at least monthly. The Student Council membership will decide each year the appropriate meetings dates andtimes. An agenda shall be prepared and handed out to each member of the Student Council at least one day before each meeting by the President or Designee. All
Items for agenda including must be submitted to the sponsor or principal two days before meetings. If quorum (half of Council members plus one) is not present for a meeting, no Council action may be voted upon.
Section 2:
each Representative shall conduct Class meetings at least two days after each Student Council meeting.
Article IX: Committees
The committees of student council shall be as follows:
Article X: Discipline
Section 1:
(School Related Discipline) If a member of student council received discipline from a school staff member, that student may be prohibited from attending the next student council meeting. Repeated discipline may lead to permanent removal from student council.Section 2: (Removal from office) Any officer or representative may be removed from office by a majority vote of the Student Council membership for poor attendance at Council meetings, failure to perform required/requested duties, or failure to follow school rules or class rules.
Article XI: Amendments to Constitution
The following procedure will be used when the Constitution needs to be amended:
A. Notice of a proposed amendment must be given in
writing to the president of the Council.
B. The proposed amendment must be discussed at the next regularly scheduled Student Council meeting.
C. The Constitution may be amended at one of the next two scheduled meetings by a two-thirds vote of the total membership.
BYLAWS
Article I: A quorum will consist of half of the total Student Council membership.
Article II: The following procedure will be used to fill an office that is vacated during the school year.
A. The Vice-President, will take the role of the President if that office is vacated.
B. If a Vice President or Secretary position becomes vacant, the position will be voted on by the entire Student Council.
Article III: The following procedure will be used when the ByLaws need to be amended:
A. Notice of a propsed by law must be given in writing to the president of the Council.
B. The propsed bylaw must be discussed at the next regularly scheduled Student council meeting.
C. The constitution may be amended at one of the next two scheduled meetings by a two-thirds vote of the total membership of the Council.

Article V: (Voting Procedures and Rules)
Section 1 Each representative shall have one vote.
Section 2 All motions require a second; all motions require (for passage) a majority vote of the Council members.
Section 3 Any and all actions of the Student council are not official until approved by the Principal.
